The Chapters on Marriage



حَدَّثَنَا يَحْيَى بْنُ مُعَلَّى بْنِ مَنْصُورٍ، حَدَّثَنَا إِسْحَاقُ بْنُ مُحَمَّدٍ الْفَرْوِيُّ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، عَنِ النَّبِيِّ ـ صلى الله عليه وسلم ـ قَالَ ‏ "‏ لاَ يُحَرِّمُ الْحَرَامُ الْحَلاَلَ ‏"‏



It was narrated from Ibn 'Umar that:

the Prophet, said: "What is Haram does not make what is Halal into what is Haram.”

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا مُؤَمَّلٌ، حَدَّثَنَا سُفْيَانُ، عَنِ الأَعْمَشِ، عَنْ سَالِمِ بْنِ أَبِي الْجَعْدِ، عَنْ أَبِي أُمَامَةَ، قَالَ أَتَتِ النَّبِيَّ ـ صلى الله عليه وسلم ـ امْرَأَةٌ مَعَهَا صَبِيَّانِ لَهَا قَدْ حَمَلَتْ أَحَدَهُمَا وَهِيَ تَقُودُ الآخَرَ فَقَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ ‏ "‏ حَامِلاَتٌ وَالِدَاتٌ رَحِيمَاتٌ لَوْلاَ مَا يَأْتِينَ إِلَى أَزْوَاجِهِنَّ دَخَلَ مُصَلِّيَاتُهُنَّ الْجَنَّةَ ‏"‏ ‏.



It was narrated that Abu Umamah said:

"A woman came to the Prophet with two of her children, carrying one and leading the other. The Messenger of Allah said: 'They carry children and give birth to them and are compassionate. If they do not annoy their husbands, those among them who perform prayer will enter Paradise."'

 حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا يَحْيَى بْنُ إِسْحَاقَ، حَدَّثَنَا يَحْيَى بْنُ أَيُّوبَ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ نَوْفَلٍ الْقُرَشِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، عَنْ جُدَامَةَ بِنْتِ وَهْبٍ الأَسَدِيَّةِ، أَنَّهَا قَالَتْ سَمِعْتُ رَسُولَ اللَّهِ ـ صلى الله عليه وسلم ـ يَقُولُ ‏"‏ قَدْ أَرَدْتُ أَنْ أَنْهَى عَنِ الْغِيَالِ فَإِذَا فَارِسُ وَالرُّومُ يُغِيلُونَ فَلاَ يَقْتُلُونَ أَوْلاَدَهُمْ ‏"‏ ‏.‏ وَسَمِعْتُهُ يَقُولُ وَسُئِلَ عَنِ الْعَزْلِ فَقَالَ ‏"‏ هُوَ الْوَأْدُ الْخَفِيُّ ‏"‏ ‏.


It was narrated that Judamah bint Wahb Al-Asadiyyah said:

"I heard the Messenger of Allah say: 'I wanted to forbid intercourse with a nursing mother, but then (I saw that) the Persians and the Romans do this, and it does not kill their children.' And I heard him say/when he was asked about coitus interruptus: 'It is the disguised form of b.rryirg children alive."

حَدَّثَنَا عَبْدُ الْوَهَّابِ بْنُ الضَّحَّاكِ، حَدَّثَنَا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ بَحِيرِ بْنِ سَعْدٍ، عَنْ خَالِدِ بْنِ مَعْدَانَ، عَنْ كَثِيرِ بْنِ مُرَّةَ، عَنْ مُعَاذِ بْنِ جَبَلٍ، قَالَ قَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ ‏ "‏ لاَ تُؤْذِي امْرَأَةٌ زَوْجَهَا إِلاَّ قَالَتْ زَوْجَتُهُ مِنَ الْحُورِ الْعِينِ لاَ تُؤْذِيهِ قَاتَلَكِ اللَّهُ فَإِنَّمَا هُوَ عِنْدَكِ دَخِيلٌ أَوْشَكَ أَنْ يُفَارِقَكِ إِلَيْنَا ‏"‏ ‏.

It was narrated from Mu'adh bin Jabal that:

the Messenger of Allah said: "No woman annoys her husband but his wife among houris (of Paradise) safs: 'Do not annoy him, may Allah destroy you, for he is just a temporary guest with you and soon he will leave you and join us."'

It was narrated from Ibn 'Abbas that:

the Prophet said: "The best of you is the one who is best to his wife, and I am the best of you to my wives."

حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى، حَدَّثَنَا بِشْرُ بْنُ عُمَرَ، حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ، عَنِ ابْنِ شِهَابٍ، عَنْ عَبْدِ اللَّهِ، وَالْحَسَنِ، ابْنَىْ مُحَمَّدِ بْنِ عَلِيٍّ عَنْ أَبِيهِمَا، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ، أَنَّ رَسُولَ اللَّهِ ـ صلى الله عليه وسلم ـ نَهَى عَنْ مُتْعَةِ النِّسَاءِ يَوْمَ خَيْبَرَ وَعَنْ لُحُومِ الْحُمُرِ الإِنْسِيَّةِ ‏.


It was narrated from 'Ali bin Abu Talib that:

Xthe Messenger of Allah forbade on the Day of Khaibar, the temporary marriage of women and (he forbade) the flesh of domestic donkeys.

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَبْدَةُ بْنُ سُلَيْمَانَ، عَنْ عَبْدِ الْعَزِيزِ بْنِ عُمَرَ، عَنِ الرَّبِيعِ بْنِ سَبْرَةَ، عَنْ أَبِيهِ، قَالَ خَرَجْنَا مَعَ رَسُولِ اللَّهِ ـ صلى الله عليه وسلم ـ فِي حَجَّةِ الْوَدَاعِ فَقَالُوا يَا رَسُولَ اللَّهِ إِنَّ الْعُزْبَةَ قَدِ اشْتَدَّتْ عَلَيْنَا ‏.‏ قَالَ ‏"‏ فَاسْتَمْتِعُوا مِنْ هَذِهِ النِّسَاءِ ‏"‏ ‏.‏ فَأَتَيْنَاهُنَّ فَأَبَيْنَ أَنْ يَنْكِحْنَنَا إِلاَّ أَنْ نَجْعَلَ بَيْنَنَا وَبَيْنَهُنَّ أَجَلاً فَذَكَرُوا ذَلِكَ لِلنَّبِيِّ ـ صلى الله عليه وسلم ـ فَقَالَ ‏"‏ اجْعَلُوا بَيْنَكُمْ وَبَيْنَهُنَّ أَجَلاً ‏"‏ ‏.‏ فَخَرَجْتُ أَنَا وَابْنُ عَمٍّ لِي مَعَهُ بُرْدٌ وَمَعِي بُرْدٌ وَبُرْدُهُ أَجْوَدُ مِنْ بُرْدِي وَأَنَا أَشَبُّ مِنْهُ فَأَتَيْنَا عَلَى امْرَأَةٍ فَقَالَتْ بُرْدٌ كَبُرْدٍ ‏.‏ فَتَزَوَّجْتُهَا فَمَكَثْتُ عِنْدَهَا تِلْكَ اللَّيْلَةَ ثُمَّ غَدَوْتُ وَرَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ قَائِمٌ بَيْنَ الرُّكْنِ وَالْبَابِ وَهُوَ يَقُولُ ‏"‏ أَيُّهَا النَّاسُ إِنِّي قَدْ كُنْتُ أَذِنْتُ لَكُمْ فِي الاِسْتِمْتَاعِ أَلاَ وَإِنَّ اللَّهَ قَدْ حَرَّمَهَا إِلَى يَوْمِ الْقِيَامَةِ فَمَنْ كَانَ عِنْدَهُ مِنْهُنَّ شَىْءٌ فَلْيُخَلِّ سَبِيلَهَا وَلاَ تَأْخُذُوا مِمَّا آتَيْتُمُوهُنَّ شَيْئًا ‏"‏ ‏.

It was narrated from Rabi'bin Sabrah that his father said :

"We went out with the Messenger of Allah on the Farewell pilgrimage, and they said : 'O Messenger of Allah, (ﷺ) celibacy has become too difficult for us'. He said : 'Then make temporary marriages with these women'. So we went to them, but they insisted on setting a fixed time between us and them. They mentioned that to the Prophet and he said : 'Set a fixed time between you and them.' So I went out with a cousin of mine. He had a cloak and I had a cloak, but his cloak was finer than mine, and I was younger than him. We came to a women and she said: 'One cloak is like another.' So I married her and stayed with her that night. Then the next day I saw the Messenger of Allah standing between the Rukn (corner) and the door (of the Ka'bah), saying : 'O people, I had permitted temporary marriage for you, but Allah has forbidden it until the Day of Resurrection. however had any temporary wives, he should let them go, and do not take back anything that you had given to them.' "

حَدَّثَنَا عَمْرُو بْنُ عَبْدِ اللَّهِ، وَمُحَمَّدُ بْنُ إِسْمَاعِيلَ، قَالاَ حَدَّثَنَا أَبُو أُسَامَةَ، عَنْ عَبْدِ الْحَمِيدِ بْنِ جَعْفَرٍ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ، عَنْ مَرْثَدِ بْنِ عَبْدِ اللَّهِ، عَنْ عُقْبَةَ بْنِ عَامِرٍ، عَنِ النَّبِيِّ ـ صلى الله عليه وسلم ـ قَالَ ‏ "‏ إِنَّ أَحَقَّ الشَّرْطِ أَنْ يُوفَى بِهِ مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ ‏"‏ ‏.

It was narrated from 'Uqbah bin 'Amir:

that the Prophet said: “The conditions most deserving to be fulfilled are those by means of which the private parts become permissible for you.”

It was narrated that Dailami said:

“I came to the Messenger of Allah, and I was married to two sisters whom I had married during the Ignorance period. He said: 'When you go back, divorce one of them.' ”

It was narrated that Abdullah said:

"Divorce according to the Sunnah means divorcing her when she is pure, ( i.e., not menstruating) and without having had intercourse with her (during that cycle)."

حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ الْجَهْضَمِيُّ، حَدَّثَنَا عَبْدُ الأَعْلَى، حَدَّثَنَا هِشَامٌ، عَنْ مُحَمَّدٍ، عَنْ يُونُسَ بْنِ جُبَيْرٍ أَبِي غَلاَّبٍ، قَالَ سَأَلْتُ ابْنَ عُمَرَ عَنْ رَجُلٍ، طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَقَالَ تَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ـ صلى الله عليه وسلم ـ فَأَمَرَهُ أَنْ يُرَاجِعَهَا ‏.‏ قُلْتُ أَيُعْتَدُّ بِتِلْكَ قَالَ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ


It was narrated that Yunus bin Jubair, Abu Ghallab, said:

"I asked Ibn 'Umar about a man who divorced his wife when she was menstruating. He said: 'Do you know 'Abdullah bin 'Umar? He divorced his wife when she was menstruating then 'Umar came to the Prophet (ﷺ) (and told him what had happened). He ordered him to take her back.' I said: 'Will that be counted (as a divorce)?' He said: 'Do You think he was helpless and behaving foolishly? [i.e., Yes, it counts (as a divorce).]."'

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، وَعَلِيُّ بْنُ مُحَمَّدٍ، قَالاَ حَدَّثَنَا وَكِيعٌ، عَنْ سُفْيَانَ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ، مَوْلَى آلِ طَلْحَةَ عَنْ سَالِمٍ، عَنِ ابْنِ عُمَرَ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ ـ صلى الله عليه وسلم ـ فَقَالَ ‏ "‏ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقْهَا وَهِيَ طَاهِرٌ أَوْ حَامِلٌ ‏"‏


It was narrated from Ibn 'Umar that:

he divorced his wife when she was menstruating, and 'Umar mentioned that to the Prophet (ﷺ). He said: "Tell him to take her back then divorce her when she is pure (not menstruating) or pregnant."

حَدَّثَنَا بِشْرُ بْنُ هِلاَلٍ الصَّوَّافُ، حَدَّثَنَا جَعْفَرُ بْنُ سُلَيْمَانَ الضُّبَعِيُّ، عَنْ يَزِيدَ الرِّشْكِ، عَنْ مُطَرِّفِ بْنِ عَبْدِ اللَّهِ بْنِ الشِّخِّيرِ، أَنَّ عِمْرَانَ بْنَ الْحُصَيْنِ، سُئِلَ عَنْ رَجُلٍ، يُطَلِّقُ امْرَأَتَهُ ثُمَّ يَقَعُ بِهَا وَلَمْ يُشْهِدْ عَلَى طَلاَقِهَا وَلاَ عَلَى رَجْعَتِهَا ‏.‏ فَقَالَ عِمْرَانُ طَلَّقْتَ بِغَيْرِ سُنَّةٍ وَرَاجَعْتَ بِغَيْرِ سُنَّةٍ أَشْهِدْ عَلَى طَلاَقِهَا وَعَلَى رَجْعَتِهَا ‏.

'Imran bin Husain:

was asked about a man who divorced his wife then had intercourse with her, and there were no witnesses to his divorcing her or his taking her back. 'Imran said: "You have divorced (her) in a manner that is not according to the Sunnah, and you have taken her back in a manner that is not according to the Sunnah. Bring people to witness your divorcing her and taking her back."

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا أَبُو الأَحْوَصِ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنِ الأَسْوَدِ، عَنْ أَبِي السَّنَابِلِ، قَالَ وَضَعَتْ سُبَيْعَةُ الأَسْلَمِيَّةُ بِنْتُ الْحَارِثِ حَمْلَهَا بَعْدَ وَفَاةِ زَوْجِهَا بِبِضْعٍ وَعِشْرِينَ لَيْلَةً فَلَمَّا تَعَلَّتْ مِنْ نِفَاسِهَا تَشَوَّفَتْ فَعِيبَ ذَلِكَ عَلَيْهَا وَذُكِرَ أَمْرُهَا لِلنَّبِيِّ ـ صلى الله عليه وسلم ـ فَقَالَ ‏ "‏ إِنْ تَفْعَلْ فَقَدْ مَضَى أَجَلُهَا ‏"‏ ‏.

It was narrated that Abu Sanabil said:

"Subai'ah Aslamiyyah bint Harith gave birth twenty-odd days after her husband died. When her postnatal bleeding ended, she adorned herself, and was criticized for doing that. Her case was mentioned to the Prophet (ﷺ) and he said: 'If she does that, then her waiting period is over."'

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا أَبُو الأَحْوَصِ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنِ الأَسْوَدِ، عَنْ أَبِي السَّنَابِلِ، قَالَ وَضَعَتْ سُبَيْعَةُ الأَسْلَمِيَّةُ بِنْتُ الْحَارِثِ حَمْلَهَا بَعْدَ وَفَاةِ زَوْجِهَا بِبِضْعٍ وَعِشْرِينَ لَيْلَةً فَلَمَّا تَعَلَّتْ مِنْ نِفَاسِهَا تَشَوَّفَتْ فَعِيبَ ذَلِكَ عَلَيْهَا وَذُكِرَ أَمْرُهَا لِلنَّبِيِّ ـ صلى الله عليه وسلم ـ فَقَالَ ‏ "‏ إِنْ تَفْعَلْ فَقَدْ مَضَى أَجَلُهَا ‏"‏ ‏.
It was narrated that Abu Sanabil said:

"Subai'ah Aslamiyyah bint Harith gave birth twenty-odd days after her husband died. When her postnatal bleeding ended, she adorned herself, and was criticized for doing that. Her case was mentioned to the Prophet (ﷺ) and he said: 'If she does that, then her waiting period is over."'

حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ، وَمُحَمَّدُ بْنُ بَشَّارٍ، قَالاَ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ دَاوُدَ، حَدَّثَنَا هِشَامُ بْنُ عُرْوَةَ، عَنْ أَبِيهِ، عَنِ الْمِسْوَرِ بْنِ مَخْرَمَةَ، أَنَّ النَّبِيَّ ـ صلى الله عليه وسلم ـ أَمَرَ سُبَيْعَةَ أَنْ تَنْكِحَ إِذَا تَعَلَّتْ مِنْ نِفَاسِهَا ‏.

It was narrated from Miswar bin Makhramah that:

the Prophet (ﷺ) told Subai'ah to get married, when her postnatal bleeding ended.

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ، وَعَمْرِو بْنِ عُتْبَةَ، أَنَّهُمَا كَتَبَا إِلَى سُبَيْعَةَ بِنْتِ الْحَارِثِ يَسْأَلاَنِهَا عَنْ أَمْرِهَا، فَكَتَبَتْ إِلَيْهِمَا إِنَّهَا وَضَعَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِخَمْسَةٍ وَعِشْرِينَ فَتَهَيَّأَتْ تَطْلُبُ الْخَيْرَ فَمَرَّ بِهَا أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ فَقَالَ قَدْ أَسْرَعْتِ اعْتَدِّي آخِرَ الأَجَلَيْنِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا ‏.‏ فَأَتَيْتُ النَّبِيَّ ـ صلى الله عليه وسلم ـ فَقُلْتُ يَا رَسُولَ اللَّهِ اسْتَغْفِرْ لِي ‏.‏ قَالَ ‏"‏ وَمِمَّ ذَاكَ ‏"‏ ‏.‏ فَأَخْبَرْتُهُ ‏.‏ فَقَالَ ‏"‏ إِنْ وَجَدْتِ زَوْجًا صَالِحًا فَتَزَوَّجِي

It was narrated that Masruq and 'Amr bin 'Utbah wrote to Subai'ah bint Harith, asking about her case.:

She wrote to them saying that she gave birth twenty-five days after her husband died. Then she prepared herself, seeking to remarry. Abu Sanabil bin Ba'kak passed by her and said: "You are in a hurry; observe waiting period for the longer period, four months and ten days." "So I went to the Prophet (ﷺ) and said: 'O Messenger of Allah, (ﷺ) pray for forgiveness for me.' He said: 'Why is that.” I told him (what had happened). He said: 'If you find a righteous husband then marry him."'
